Personal or Company checks may be accepted only if they can be run through our Telecheck Machine. BALANCE AND FULL PAYMENT DUE ON DAY OF SALE. Purchases not paid for will be resold and deposit will be forfeited.
2. WHILE DESCRIPTIONS ARE BELIEVED TO BE CORRECT, THE AUCTIONEERS OR THE OWNERS MAKE NO WARRANTIES OR GUARANTEES, EXPRESSED OR IMPLIED, as to the genuineness, authenticity of, or defect in any lot and will not be held responsible for advertising discrepancies or inaccuracies. Everything is sold "AS IS" and "WHERE IS" except as expressively made in writing. No warranties are made as to the merchantability of any items for their fitness for any purpose. Always make a personal inspection before bidding, and bid according to your observations or beliefs.
3. It is the buyer's responsibility to secure all safety equipment to meet all applicable government safety standards in using or removing items purchases.
4. Sales Tax will be added to the purchase of all taxable items. Dealers who purchase for resale must file their resale permit numbers.
5. Purchaser does hereby indemnify and hold harmless auctioneer and seller from any and all damages, claims or liabilities from injuries to persons or to property of any type whatsoever caused during the sale or during the removal of items purchased.
6. In the event the purchaser fails to pay the whole of the purchase within the time set fourth by the auctioneers and/or fails to comply with any of the conditions or terms of sale, the seller may retain and/or recover the deposit specified as liquidated damages, and in addition thereto, items that are not paid for can be resold at public or private sale without further notice. Any deficiency resulting from such resale shall be paid to the auctioneers by the defaulting purchaser, together with all charges, fees and expenses incurred by such resale and enforcement of the obligation hereunder.
7. In the event of non-delivery of purchased items for any reason whatsoever, the Auctioneer's only obligation and liability to the purchaser is to return the monies deposited for such non-delivered items. If any shortage exists on estimated counts, claims for this must be noted by the purchaser at time of removal. There will be no adjustments or credits made after items are removed from the premises.
8. Purchaser agrees to remove all items from the premises within the removal period announced at the sale. There will be no removal until the end of sale. Purchaser assumes solely all expenses, risks and liabilities for removal. If equipment is not removed within specified removal time, purchaser shall be liable for any moving and storage costs incurred, and if not so removed, the items shall be deemed abandoned.
9. If any dispute arises between two or more bidders, the Auctioneer may or may not, at his sole discretion, reopen the bidding.
10. The auctioneer reserves the right to group one or more lots into one or more selling lots, or to add to, or delete lots at his sole discretion. The auctioneer reserves the right to reject any bid which is only a fractional advance over the preceding bid. Auctioneer and seller reserves the right to reject any or all bids and to add or delete merchandise until the item is pronounced "sold".
11. Proxy bids may be submitted to the auctioneer prior to the sale if accompanied by a deposit for 25% of the bid. All proxy bids will be held in confidence.
12. The auctioneer, when acting as an agent only, is not responsible for acts of its principals.ALL SALES ARE FINAL. ALL ITEMS ARE SOLD "AS IS-WHERE IS," WITH ALL FAULTS AND WITHOUT WARRANTIES.
All auction sales will be recorded. This audio record of the number of the bidder, the bid, and amount thereof shall be prima facie evidence of the circumstances of the sale, and all disagreements will be resolved with this record.
McCormack Auction is not responsible for any loss or damages of auction items not removed by Purchaser from the auction site by allotted time for removal stated in description. If the purchaser at his sole option elects to leave equipment on the site after said time he does so at his own risk and accepts full responsibility for any loss or damage.

Bidders failing to comply with the above Terms of Payment and Removal may be removed from the bidder list. In addition, future bids from those bidders not in compliance with the Terms and Conditions of sale may not be accepted by the office.
